Welcome to Fayds (“App”), owned and operated by Faydgroup LLC (“Company,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the App.
By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
• The App is strictly for users 18 years of age or older.
• By using the App, you represent and warrant that you are at least 18.
• We reserve the right to suspend or terminate accounts that misrepresent age.
2. User Accounts
• You must create an account to access certain features.
• You are responsible for maintaining the confidentiality of your account.
• You may not create more than one account or impersonate others.
• We reserve the right to suspend or terminate accounts at our discretion.
3. User-Generated Content (UGC)
• Users may upload, post, or share content including videos, images, audio, and text (“Content”).
• You retain ownership of your Content.
• By posting Content, you grant Company a non-exclusive, worldwide, royalty-free, sublicensable license to host, display, distribute, modify, and promote your Content within the App and related marketing.
• You represent that you own or have permission to use all rights in your Content.
4. Community Guidelines & Prohibited Conduct
You agree not to post or engage in:
• Illegal, harmful, or deceptive behavior
• Harassment, hate speech, or explicit content
• Copyright or trademark infringement
• Automated, bot, or fake engagement
• Manipulation of points or rewards systems
We reserve the right to remove Content or terminate accounts at any time.
5. Points System (No Cash Value)
• Points are virtual, non-monetary units used solely within the App.
• Points have no cash value, are not currency, and cannot be redeemed for money.
• Points may be given by users to other users to recognize skill-based talent or creativity.
• Users cannot give points to themselves.
• Points cannot be sold, transferred outside the App, or exchanged for cash.
• Points may expire or be adjusted at our discretion.
6. Rewards & Redemptions
• Accumulated points may be redeemed in-app only for prizes or gift cards.
• Rewards are fixed-value and guaranteed upon redemption, subject to availability.
• Gift cards and third-party rewards are subject to issuer terms.
• Rewards are non-transferable and may not be exchanged for cash.
• Redemption thresholds and rewards may change at any time.
7. Subscriptions
• The App offers optional paid subscriptions.
• Subscriptions may provide points that can be given to other users only, not to oneself.
• Subscription points may be used to recognize talent but do not affect contests or rankings.
• Subscriptions provide features and convenience benefits only.
• Subscriptions automatically renew unless canceled through the App Store or Google Play.
• No refunds for partial billing periods unless required by law.
8. No Gambling or Chance-Based Rewards
• The App does not offer gambling, lotteries, or chance-based prizes.
• Points are not awarded or redeemed by chance.
• All rewards are fixed-value and not random.
• Subscriptions do not increase chances of winning prizes.
9. Intellectual Property
• All App content, features, and trademarks are owned by Company or its licensors.
• You may not copy, modify, or distribute App materials without permission.
10. Account Suspension & Termination
We may suspend or terminate your account if you:
• Violate these Terms
• Engage in fraudulent or abusive behavior
• Attempt to exploit points, rewards, or subscriptions
Termination may result in loss of points and rewards without compensation.
11. Disclaimer of Warranties
The App is provided “as is” and “as available.” We make no warranties regarding uninterrupted service or error-free operation.
12. Limitation of Liability
To the fullest extent permitted by law:
• We are not liable for indirect or consequential damages.
• Our total liability shall not exceed the value of rewards redeemed by you.
13. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
14. Dispute Resolution
• Disputes shall first be attempted to be resolved informally.
• If unresolved, disputes will be resolved by binding arbitration in Tampa, Florida, under AAA rules.
15. Changes to These Terms
We may update these Terms at any time. Continued use of the App constitutes acceptance of the updated Terms.
